Fernva Terms of Service

These Terms of Service govern your use of fernva.com and purchases from Fernva. By using the website or placing an order, you agree to these terms and to our Privacy, Shipping, and Returns & Refunds Policies.

Eligibility

Browsing is not age-restricted. To place an order, you must have reached the legal age required to enter into a binding contract where you live. The website and its services are not directed to children under 13.

Store and products

Fernva is an independently operated online pet-accessories brand serving customers in Australia. Product colours, textures, dimensions and packaging may vary slightly from images or descriptions. Please check measurements and suitability for your pet before purchase. We may correct errors, update information, limit quantities, refuse or cancel orders, or discontinue products where reasonably necessary.

Pet safety

Our products are not veterinary or medical devices and are not a substitute for professional advice. Supervise pets during use, inspect products regularly and stop use immediately if an item is damaged. Do not use a cooling mat if it is punctured, leaking or torn. Keep grooming tools away from wounds, eyes and sensitive skin. You are responsible for assessing the suitability of harnesses, beds, tunnels, toys, scratchers and grooming tools against your pet’s actual size, behaviour and condition.

Prices, orders and payment

All prices are displayed in Australian dollars (AUD). The total amount payable, including any applicable GST or mandatory charges, is shown at checkout as required by law. Payment may be processed by PayPal or another payment provider offered at checkout. An order confirmation does not guarantee acceptance; an order is accepted when we begin fulfilment.

Cancellations and address changes

Requests made within 12 hours of ordering may be accepted if fulfilment has not started. Once our fulfilment partner begins processing or dispatching an order, changes or cancellation cannot be guaranteed. Customers may be responsible for additional costs caused by an incorrect or incomplete delivery address.

Shipping, returns and refunds

Fernva currently delivers within Australia only. Delivery estimates are not guarantees. Shipping, delays, loss, delivery disputes, returns and refunds are addressed in our Shipping Policy and Returns & Refunds Policy, which form part of these terms.

Australian Consumer Law

Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded.

Acceptable use

You must not misuse the website, interfere with its security or operation, introduce malicious code, scrape or copy content at scale, impersonate another person, provide false information or use the website for unlawful activity. Fernva content, branding, graphics and original materials are owned by or licensed to Fernva and may not be commercially reproduced without permission.

Third-party services

The store is hosted by Shopify and may use third-party fulfilment, payment, review, analytics, advertising, email, SMS or customer-support services. Those services may have separate terms. Fernva is not responsible for third-party websites or services outside our reasonable control.

Disclaimers and liability

To the maximum extent permitted by law, Fernva is not liable for indirect, incidental or consequential losses, or for delays and failures caused by events outside our reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded or limits mandatory consumer protections.

Changes and severability

We may update these terms by posting a revised version and effective date. If any provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver.
